Under Florida law, when a creditor receives a judgment against someone, that judgment is recorded in the county records. The recorded judgment then acts as a lien against real property located in that county. However, recorded judgments are not supposed to act as liens on homestead property. In reality, these recorded judgments will act as a “cloud on title” and title companies will not issue clear title to refinance to sell your property if there is a recorded judgment against you.

However, during the bankruptcy process, you will obtain an order from the Bankruptcy Judge that will prevent any judgments from acting as liens against your Homestead. This is an important and valuable right that will prevent problems for you and your property in the future.
