Filing for Chapter 13 provides many of the same benefits as other forms of debt restructuring. In many cases, though, it comes with a number of additional benefits that traditional methods can’t offer. Perhaps most important is the automatic stay. Once you file for bankruptcy, your creditors are required to stop all collection activity, including phone calls, letters and lawsuits.
Within a Chapter 13 filing, we can restructure your loans. There are a number of adjustments that may be able to be made to mortgages, including reducing the amount of the mortgage to the value of the property, changing the interest rate and, if the property is not your primary residence, possibly extending the duration of the loan. We can also make adjustments to auto loans in a Chapter 13, including the possibility of changing the interest rate.
